In the landmark case Mobley v. Workday, Inc. (2025), a federal court in California granted preliminary certification to a collective of job applicants over the age of 40 who alleged Workday's AI-powered hiring system unfairly screened them out.

According to the complaint, hundreds of older applicants were rejected without interviews after applying through platforms powered by Workday's technology. The plaintiffs argued that Workday's algorithmic filtering system systematically disqualified candidates based on age, despite AI being marketed as an objective tool.

Judge Rita Lin ruled that the collective could proceed, citing that all plaintiffs were subject to the same AI-driven process, which introduced bias at scale and placed them at an unequal starting point in the job market. The case is still in motion, but it has already set a precedent: leaders can no longer treat AI as a black box when it influences hiring outcomes.

AI tools promise speed and efficiency, but as this case shows, they can also embed bias in subtle but devastating ways.
